Summit Games (“us”, “our” or “we”) is dedicated to protecting the privacy rights of our users (“users” or “you”). This Privacy Policy (this “Policy”) describes the ways we collect, store, use, and manage the information, including personal information, and data that you provide or we collect in connection with our website, www.summit-games.com (the “Site”), or any Summit Games game provided on a mobile platform (for example, iOS and Android) (collectively, the “Service(s)”). Please note that the scope of this Policy is limited to information and data collected or received by Summit Games through your use of the Service. Summit Games is not responsible for the actions of third party people or companies, the content of their sites, the use of information or data you provide to them, or any products or services they may offer. Any link to those sites does not constitute our sponsorship of, or affiliation with, those people or companies.

By using the Service, you are expressing your agreement to this Policy and the processing of your information and data, including your personal information, in the manner provided in this Policy. If you do not agree to these terms, please do not use the Service.

This Policy sits alongside our Terms of Service, which set out the rules for playing our games.

The Data We Collect from You

Data you provide us

We might collect your email address when you directly contact us by email.

Where a game offers an account, you may also give us an email address and password, a display name, and the other account details described in “Game Accounts” below.

Data we collect automatically

We automatically collect the following data from you when you use the Service:

• Mobile advertising identifiers, such as your device's unique advertising ID (Apple IDFA or Google AAID).
• Data about your device, such as device type and model, network provider, browser type, device language, IP address, and network connection type.
• Crash reports generated by your device when using the Service.
• General location data (such as country or region, derived from your IP address).
• Data about your use of the Service, such as gameplay data.
• Data about how you came to install the Service, such as the advertising campaign or the app store referral that led to the install.
• Data about purchases you make in the Service, such as the product, its price and currency, and the store receipt.

Game Accounts

Some of our games give you an account, so that your progress is saved on our servers and can be recovered. This section applies only to those games. Features marked “Skybound” exist only in Skybound.

What the account holds

• An account identifier, created automatically the first time you play — you do not need to sign up.
• Your display name and the profile choices you make in the game, such as a profile picture or a title.
• Your progress and game records: experience and level, in-game currencies and items, scores, times, rankings, streaks, and play time and distance statistics.
• A record of your in-app purchases (product, price, store transaction identifiers and receipt), so they can be verified, credited, restored and, if refunded, reversed.
• Your country, taken from your device's region setting, for country leaderboards.
• Technical data used to keep the game fair, such as signs that a device's clock was changed.
• If you choose to add them: your email address and a password, so you can sign in on another device. Passwords are stored only in hashed form.

Features in Skybound only

• Sign in with Apple (on Apple devices): if you use it, Apple shares with us an identifier for your Apple account and an email address, which may be a private relay address Apple creates for you. We also keep a token from Apple so that, if you delete your account, we can revoke the game's access to your Apple ID, as Apple requires.
• Friends: you can add other players by their handle (display name plus a number, such as Name#1234). Your friends can see your display name, profile picture, best scores and when you were last active.
• Run recordings: your Daily Challenge runs are recorded so that other players can race against your “ghost”.

What other players can see

Your display name, profile picture, title, level, scores, times and rankings appear on public leaderboards and on your profile. Your email address, password and purchases are never shown to other players.

Why we process it

Account data is needed to provide the game you chose to play: saving your progress, running leaderboards and delivering what you buy (performance of a contract). Fair-play data is processed on the basis of our legitimate interest in keeping leaderboards and purchases honest.

Where it is stored

Skybound stores account data with our backend provider, Supabase — https://supabase.com/privacy. Our other games store it on our own servers hosted by Amazon Web Services (see “Contact Information of Data Controller” below).

Deleting your account

You can delete your account at any time from the game's settings. Deletion permanently removes the account and the data listed above from our servers, including your leaderboard entries and in-game items, and cannot be undone. Signing out is not deletion: your account stays on our servers so that you can sign back in.

Why Do We Collect Your Data

To improve the Service

In order to improve our Service, we have a legitimate interest to collect and process necessary data about your device when you use the Service, such as its operating system version, type and model, language and wireless operator, and crash reports.

It helps us analyse the use of the Service and fix bugs that might occur when using the Service.

To show personalized advertisements

To maintain the use of the Service free of charge for you, we have a legitimate interest to collect and process your device advertisement ID. Where required by law, we will ask for your consent before processing this data for personalized advertising.

It helps us to show you ads that are more relevant to you.

To share with you news about the Service, such as the release of a new game

We may use your email address when you contact our customer service to contact you about your gaming experience with Summit Games games and notify you about company news.

If you no longer wish to receive certain email notifications you may opt-out at any time by emailing us with the contact information provided in this Policy.

How We Use Your Data

Analytics

We have partners to perform analytics services for us. These partners might process your data according to their privacy policy.

You can find below a list of our analytics partners, with a link to their privacy policy, so that you can have information on how they process your data:

Install attribution

Skybound uses an attribution partner to understand which advertising campaigns lead people to install the game, and whether those campaigns bring players who keep playing. Our other games do not use one.

When you open the Service, the following is shared with this partner:

• your advertising identifier (only where you have allowed tracking, or where the law otherwise permits it);
• device data and your IP address;
• the app store's install referral information;
• a limited set of in-game milestones, such as finishing the tutorial, coming back on later days, or reaching certain experience levels;
• in-app purchase receipts and advertising revenue.

The partner uses this data to measure our campaigns and to report results to the advertising networks we buy ads from, so that they can improve those campaigns. Where the law requires it, this happens only once you have given your consent. You can change your choice at any time from the device settings described in “Your Rights and Options” and, where available, from “Privacy choices” on the game's Help page.

Advertising

When you use our Service, your advertising identifier and other information from your device is collected and shared with advertising partners to enable the technical delivery of ads to your device.

Our advertising partners may combine this information with information which they have collected about you when you use their services (or the websites or services of third parties) in order to serve you more relevant ads in our games or to improve the accuracy of their targeting and measurement systems.

How We May Disclose Your Information to Third Parties

We do not disclose your information to third parties with the exception of our analytics, attribution and advertising partners mentioned above.

For each partner, you can find information on how they process, store and share your data in their privacy policy.

In games with accounts, account data is stored by our backend providers (see “Game Accounts”), and the public profile information described there is visible to other players.

Data Retention

We retain your data only for as long as necessary for the purposes described in this Policy. Email correspondence is kept for as long as needed to handle your request and a reasonable period thereafter. Device and usage data collected for analytics and advertising is retained in line with our partners’ retention practices, after which it is deleted or anonymized. When data is no longer required, we delete or anonymize it.

Account data is kept for as long as your account exists, and deleted when you delete the account.

International Data Transfers

Our Service is global by nature and your data can therefore be transferred to anywhere in the world. Because different countries may have different data protection laws than your own country, we take steps to ensure adequate safeguards are in place to protect your data as explained in this Policy. Where data is transferred outside the European Economic Area or the United Kingdom, adequate safeguards that we and our partners may rely on include the European Commission’s Standard Contractual Clauses and, for transfers to certified organizations in the United States, the EU–U.S. Data Privacy Framework (and its UK extension).

Children's Privacy

We care about the privacy of children. Some of our games may be enjoyed by a general audience, including children.

We do not knowingly collect personal information from children in a way that would require verifiable parental consent under applicable law (such as the U.S. Children's Online Privacy Protection Act, “COPPA”, or the GDPR). For users we identify or treat as children under the applicable age of digital consent, we instruct our advertising partners to serve only non-personalized (contextual) advertising and we do not collect advertising identifiers for the purpose of behavioral targeting.

Your Rights and Options

Opt-out of targeted advertising

You can exercise an opt-out for interest-based advertising services on mobile applications by checking the privacy settings of your Android or iOS device and selecting “limit ad tracking” / disabling “Allow Apps to Request to Track” (Apple iOS) or “opt-out of interest based ads” / resetting your advertising ID (Android).

Your other rights

Depending on where you live, you may have the right to access your data, correct your data, have your data deleted, receive a copy of your data in a portable format, object to how we use or share your data, and restrict how we use or share your data. You can always withdraw your consent where processing is based on consent.

We will respond to all requests within a reasonable timeframe. You may also lodge a complaint with your local data protection authority (within the European Economic Area or the United Kingdom) for unresolved complaints.

In games with accounts, you can delete your account and its data yourself at any time from the game's settings.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the right to know what personal information we collect, to request access to or deletion of your personal information, to correct inaccurate information, and to opt out of the “sale” or “sharing” of your personal information for cross-context behavioral advertising. The sharing of advertising identifiers with our advertising partners described above may be considered a “sale” or “sharing” under California law.

You can opt out by limiting ad tracking in your device settings as described above, or by contacting us at hello@summit-games.com. We will not discriminate against you for exercising any of these rights.

Cookies & Similar Technologies

We do not use cookies or similar technologies when you browse the Site.

Our analytics and advertising partners may use cookies and similar technologies (or mobile equivalents such as advertising identifiers) to analyse the use of the Service and target advertisements.

Security

We take reasonable precautions to protect personal information from misuse, loss and unauthorized access.

Changes to This Policy

We may update this Policy to reflect changes to our data and information privacy practices. When we make material changes, we will update the “Last updated” date at the top of this page. We encourage you to periodically review this page for the latest information on our privacy practices.
